New UAE Labour Law decree: Find out the categories exempt from overtime pay

Dubai: If your employer has asked you to work extra hours, you are entitled to overtime wages. However, if your occupation or position in the company falls under some categories, you may not be eligible for overtime pay. The exceptions for being exempted from overtime pay are are outlined in a ministerial resolution issued by the Ministry of Human Resources and Emiratisation (MOHRE). Following the implementation of the new UAE Labour Law in February this year, (https://gulfnews.com/living-in-uae/ask-us/new-uae-labour-law-comes-into-effect--all-you-need-to-know-1.1643740434460 ) MOHRE has issued several Ministerial Resolutions or decrees, which provide further details on the various situations and special conditions related to the implementation of the law. One such decree is Cabinet Resolution No. (1) of 2022, which provides details on the implementation of the new UAE Labour Law - Federal Decree-Law No. (33) Of 2021. Article 15 of this resolution looks at various conditions related to the working hours and how they will be calculated, as per law, for an employee. Clause 4 of Article 15 explains that depending on the worker’s job and seniority, overtime pay may not apply.
