US backs court repeal of year-round E15 rule
Washington, 9 December (Argus) — President Joe Biden's administration has urged the US Supreme Court not to revisit a court ruling that threw out a regulatory waiver that made it easier for retailers to sell 15pc ethanol gasoline (E15) blends year-round across the US.
The US Court of Appeals for the DC Circuit this summer threw out a 2019 rule that said E15 qualified for an emissions waiver the Clean Air Act offers for fuel blends "containing" 10pc ethanol. But the Biden administration said a request by biofuel group Growth Energy for the Supreme Court to reverse that decision is not warranted, partly because the case has limited importance.
"Upholding the rule at issue here would not lead to widespread use of E15," the administration said in a court filing on 8 December.
